Jobity Terms of Service
1. Who we are, and what these Terms cover
Jobity is operated by JOBITY LLC, a Wyoming limited liability company with a registered address at 30 N Gould St, Ste N, Sheridan, WY 82801. In these Terms, “Jobity”, “we”, “us”, and “our” mean JOBITY LLC. “You” and “your” mean the person using the Service.
These Terms are a binding contract between you and Jobity. They govern your use of the Jobity website at jobity.io, the Jobity application at app.jobity.io, and every related feature, email, and service we provide (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Section 15 contains a binding arbitration agreement and a class action waiver. It affects how disputes between you and Jobity are resolved. Please read it.
2. Definitions
- “Your Content” — everything you give us or authorize us to collect: your resume, work and education history, contact details, job preferences, answers to application questions, cover letters, uploaded files, and anything you type into the Service.
- “AI Output” — anything the Service generates using automated or machine-learning systems: tailored resumes, drafted cover letters, generated answers to employer questions, job matches, and summaries of email you receive.
- “Application” — a job application prepared through the Service and submitted to an employer or an applicant tracking system on your behalf.
- “Employer Content” — job postings, application forms, company information, and other material originating from employers or their vendors that the Service displays to you.
- “Jobity+” — our paid subscription.
- “Credits” — the units the Service consumes when it submits an Application for you.
3. Eligibility and your account
You must be at least 18 years old to use the Service. We do not knowingly collect information from anyone under 18. If we learn that an account belongs to someone under 18, we will close it.
The Service is offered to people located in the United States. You may use it to apply for jobs posted anywhere in the world, but we do not offer the Service outside the United States, and we may decline or close an account we believe is outside it.
You must register with accurate information and keep it current. You are responsible for everything that happens under your account and for keeping your login credentials secure. Tell us at support@jobity.io as soon as you suspect unauthorized access.
You may not share your account, sell it, or transfer it to anyone else.
4. Accuracy of your information — your responsibility
Everything the Service submits on your behalf comes from what you tell it. The Service prepares Applications using your profile, your resume, and your saved answers. It does not independently verify any of it.
You represent and warrant that:
- Your resume, work history, education, certifications, licenses, and every other fact in your profile are true, accurate, and complete;
- You have the legal right to work in the locations you say you do, in the manner you say you do;
- Any credential, clearance, registration, or license reflected in your profile is one you actually hold and that is actually current;
- You will correct your profile promptly when any of this changes.
You are solely responsible for the truth of every statement submitted to an employer through the Service, whether you typed it, our AI drafted it, or the Service filled it in automatically. A false statement in a job application can cost you an offer, get you terminated, or expose you to legal liability. Jobity has no way to detect one and accepts no responsibility for one.
5. Automated Application Authorization
This section describes what the Service does in your name. Read it carefully.
5.1 Your authorization
By using the Service to apply for jobs, you authorize Jobity to act as your agent for the limited purpose of preparing, completing, signing, and submitting Applications on your behalf, and to communicate with employers about those Applications through the email relay described in Section 7.
You adopt every Application submitted through the Service as your own statement to the employer, as if you had typed and sent it yourself.
5.2 Two modes: review-first and auto-apply
The Service has two modes, and review-first is the default:
- Review-first (default). The Service prepares the Application and presents it to you. Nothing is sent until you approve it.
- Auto-apply (optional, off by default). If you turn auto-apply on, the Service prepares and submits Applications without showing them to you first. No human at Jobity reviews them either.
You may switch modes at any time in your profile settings. Turning auto-apply on is your decision and your risk. Read Section 5.3 before you do.
5.3 What the Service answers for you
When completing an application form, the Service does the following. This applies in both modes, but in review-first mode you see the result before it is sent, and in auto-apply mode you do not.
- Certification and acknowledgement boxes. Where a form has a single required checkbox — “I certify the information above is true”, “I agree”, “I acknowledge” — the Service checks it. It does this even when the surrounding text warns about misrepresentation, fraud, or termination, because the box has no alternative answer and the application cannot be submitted without it. When the Service checks such a box, you are making that certification. It is your certification, not ours. This is why Section 4 matters.
- Eligibility and disclosure questions. Questions about work authorization, visa sponsorship, citizenship as an eligibility condition, export-control or ITAR status, Selective Service registration, security clearance, background-check consent, criminal history, professional-discipline history, bankruptcy, conflicts of interest, prior employment or applications at the hiring company, non-compete obligations, and professional credentials are answered by our automated systems from the information in your profile. They are not answered with generic defaults. They are only as correct as your profile is.
- Demographic and self-identification questions. Where an employer asks about race or ethnicity, veteran status, or disability status, the Service selects a decline-to-answer option where one is offered (for example, “Decline to Self Identify” or “Prefer not to answer”). Declining to self-identify is lawful and does not affect your candidacy. If you want to self-identify, use review-first mode and change the answer before you approve.
- Salary expectations. Where an employer asks and offers a suitable option, the Service selects a non-committal answer such as “Negotiable” or “Market Rate”.
5.4 Applications cannot be recalled
Once an Application is submitted, it is gone. We cannot recall it, edit it, unsend it, or make an employer delete it. If an Application was sent with wrong information — for any reason, including our error — your only remedy is to contact the employer yourself.
5.5 No guarantee, and no obligation to submit
We do not guarantee that any Application will be submitted, delivered, received, read, or acted on. Employers and applicant tracking systems change their forms, block automated traffic, require CAPTCHAs, and reject submissions for reasons we cannot see or control. See Sections 9 and 13.
6. AI Output
The Service uses artificial intelligence to tailor resumes, draft cover letters, generate answers to employer questions, match you to jobs, and summarize email.
AI Output can be wrong. It can be inaccurate, incomplete, out of date, or plainly fabricated. It may overstate your experience, restate your history imprecisely, or produce an answer that does not reflect what you would have said.
- AI Output is provided for your review. You are responsible for checking it before it goes to an employer. In auto-apply mode you have waived that review — see Section 5.2.
- AI Output is not career, legal, immigration, tax, or professional advice.
- Employers and job platforms may use AI-detection or bot-detection tools. We do not guarantee that AI Output will pass any such tool, and we are not responsible if it does not.
- As between you and Jobity, you own AI Output generated for you, subject to the license in Section 11. We make no representation that AI Output is original or that it does not resemble output generated for someone else.
7. Email relay
To keep your personal inbox clean and to track responses to your Applications, the Service can issue you an email address on a domain that Jobity operates, and use that address on your Applications.
By using this feature you understand and agree that:
- Mail sent to that address is received by Jobity’s systems, processed automatically — including by AI systems that classify, summarize, and clean up message content — and then forwarded to you. Replies you send through the Service travel back out the same way.
- Recipients are not told that the address is a relay. Employers, recruiters, and anyone else who writes to it will treat it as your address.
- You must not use the relay for anything other than your own job search. No marketing, no bulk mail, no harassment, no unlawful content, and nothing that would put our sending domains at risk.
- Email delivery is not guaranteed. Mail can be delayed, filtered as spam, rejected, or lost, in either direction. We are not liable for a message you did not receive or that the employer did not receive.
- We currently retain relayed mail indefinitely. See Section 8 and our Privacy Policy.
You are responsible for the content of every message you send through the relay.
8. Data retention and deletion
We currently retain your data — including your profile, your Applications, and mail received or sent through the email relay — indefinitely. We do not automatically delete it after any set period.
You may ask us to delete your account and your data by emailing support@jobity.io. We will process the request manually within a reasonable time. Some information may be retained where we are required to keep it (for example, payment and tax records), and mail already delivered to an employer or already in your own inbox cannot be recalled. Backups are overwritten on their own cycle.
Our Privacy Policy describes what we collect, why, and who we share it with.
9. Third-party platforms, employers, and job data
9.1 Applicant tracking systems and job platforms
The Service interacts with third-party systems — applicant tracking systems, employer career pages, and job platforms — that we neither own nor control.
Many of those platforms have their own terms, and some restrict automated access or automated form submission. You are responsible for your own compliance with the terms of any platform where you hold an account. A platform may throttle, block, suspend, or reject your submissions, or suspend an account you hold with it. We are not liable for that, and it does not entitle you to a refund beyond the Credit return described in Section 10.
9.2 Employer Content
Job postings and company information shown in the Service come from employers and public sources. We do not verify them. A posting may be out of date, filled, mispriced, mislocated, duplicated, or fraudulent. Do your own diligence before applying and before sharing anything sensitive with anyone who contacts you.
Employer names, logos, and trademarks belong to their owners. Their appearance in the Service does not mean the employer sponsors, endorses, or is affiliated with Jobity. If you are an employer or rights holder and want your material removed, email support@jobity.io and we will review it.
9.3 Communications from employers
Anything an employer or recruiter tells you is theirs, not ours. We do not screen it. Be alert for recruitment scams, including anyone asking you for payment, banking details, or identity documents early in a process.
10. Jobity+, Credits, and payment
10.1 Subscription and auto-renewal
Jobity+ is offered on monthly and quarterly billing terms. Your subscription renews automatically at the end of each billing period, and your payment method is charged automatically, until you cancel. Prices are stated at checkout.
You can cancel at any time from your billing settings. Cancellation stops future renewals. It takes effect at the end of the period you have already paid for; you keep access until then.
Payments are processed by Stripe. We do not store your full card details. Your use of Stripe’s checkout is also subject to Stripe’s terms.
10.2 Credits
The Service consumes one Credit each time it submits an Application for you.
- Subscription Credits are granted with each billing period of an active Jobity+ subscription. They are tied to that period and do not roll over into the next one.
- Bonus Credits are Credits we grant outside a subscription — for example, a promotional or goodwill grant. Bonus Credits do not currently expire, though we may introduce an expiry for Credits granted in the future by giving notice under Section 17.
- A Credit is reserved when an Application starts and consumed only when the Application is successfully submitted. If the submission fails, the Credit is returned to your balance. A Credit reserved by a job that never completes is released automatically.
- Credits have no cash value, cannot be redeemed for money, and cannot be transferred or sold.
10.3 Refunds
Fees for Jobity+ are non-refundable except where required by law. We may issue a refund or a Credit grant at our discretion; doing so once does not oblige us to do it again. If you believe you were charged in error, email support@jobity.io and we will look at it.
A submitted Application cannot be recalled and its Credit cannot be returned, even if you change your mind, even if the Application contained a mistake. See Section 5.4.
10.4 Price changes and taxes
We may change prices. A change to your recurring price takes effect on your next renewal and we will tell you before it does. Prices exclude taxes unless stated otherwise; you are responsible for any applicable taxes.
10.5 Failed payment
If a charge fails, we may retry it, suspend paid features, or downgrade your account until payment succeeds.
11. Your Content, and the license you give us
You keep ownership of Your Content. We do not claim it.
You grant Jobity a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, adapt, and display Your Content and AI Output, solely to operate, secure, support, and improve the Service for you — including preparing and submitting Applications, generating AI Output, matching you to jobs, and relaying your email. This license lasts as long as we hold the content and ends when we delete it under Section 8.
We do not use Your Content to train artificial-intelligence models, our own or anyone else’s, and we do not sell it. We do use third-party AI providers to process it on our behalf, under contracts that restrict what they may do with it. See the Privacy Policy.
You represent that you have the right to give us this license and that Your Content does not infringe anyone’s rights or violate any law.
Feedback. If you send us suggestions or ideas about the Service, we may use them freely and without obligation to you.
12. Acceptable use
You agree not to:
- Provide false, misleading, or fraudulent information in a profile or an Application, including about your identity, qualifications, credentials, employment history, criminal or disciplinary history, or legal authorization to work;
- Apply for jobs you have no genuine intent to be considered for;
- Use the Service on behalf of another person without their authorization, or operate accounts for other people as a service;
- Scrape, crawl, harvest, or systematically extract data from the Service; use bots or automated tools against the Service other than the features we provide; or resell, redistribute, or commercially exploit any part of it;
- Reverse-engineer, decompile, or attempt to derive the source code of the Service, or circumvent any rate limit, access control, or security measure;
- Use the Service or the email relay to send spam, malware, harassment, hateful or unlawful content, or anything that endangers our sending reputation;
- Interfere with the Service’s operation or with anyone else’s use of it;
- Use the Service to build a competing product or service.
Fair use and operational safeguards. To protect the Service, our sending domains, and other users, we may queue, batch, delay, throttle, cap, or decline submissions, generations, and other requests, and may restrict specific destinations or providers. We may do this at our discretion and without notice.
13. Not an employment agency. No guarantee of outcome.
Jobity is software. It is not an employment agency, employment business, staffing agency, recruiter, or career counselor. We do not employ you, place you, represent you to employers as a recruiter would, negotiate on your behalf, or receive any fee from an employer for hiring you.
We do not guarantee any outcome. Not an application delivered, not a response, not an interview, not an offer, not a salary, not a timeline. Job search results depend on the market, on employers, and on you.
14. Disclaimers, limitation of liability, and indemnity
14.1 Service provided “as is”
THE SERVICE, AI OUTPUT, AND EMPLOYER CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain warranty exclusions, so parts of this may not apply to you.
14.2 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBITY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST EARNINGS, LOST OPPORTUNITIES, LOST EMPLOYMENT, LOST GOODWILL, OR LOST OR CORRUPTED DATA, whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not we were told such damages were possible.
JOBITY’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID JOBITY IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits apply even if a limited remedy fails of its essential purpose. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud.
14.3 Indemnity
You will defend, indemnify, and hold harmless Jobity and its members, officers, employees, and agents from any claim, loss, damage, liability, cost, or expense (including reasonable attorneys’ fees) arising out of or relating to: (a) Your Content; (b) any statement, certification, or disclosure submitted to an employer through the Service; (c) your use of the Service; (d) your breach of these Terms or of any law; (e) your violation of any third party’s rights; or (f) your violation of the terms of any third-party platform.
15. Dispute resolution — arbitration and class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
15.1 Informal resolution first
Before starting an arbitration, you agree to email support@jobity.io describing the dispute and what you want. We will do the same for a dispute we have with you. If we cannot resolve it within 60 days, either of us may start an arbitration.
15.2 Agreement to arbitrate
Except as stated in Sections 15.3 and 15.5, you and Jobity agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and not in court.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted by a single arbitrator. You may choose to have the hearing conducted by telephone or video, or in the county where you live; you are not required to travel to Wyoming. The arbitrator may award any relief a court could award to you individually.
The Federal Arbitration Act governs the interpretation and enforcement of this section.
15.3 Exceptions
Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also seek injunctive relief in court to stop infringement or misuse of intellectual property.
15.4 Class action waiver
YOU AND JOBITY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of class proceeding. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — will proceed in court, and the rest of this Section 15 will remain in force.
15.5 Your right to opt out
You may opt out of this arbitration agreement. Email support@jobity.io with the subject line “Arbitration Opt-Out”, stating your name and the email address on your account, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms, and we will not treat it as a reason to close your account.
15.6 Time limit
Any claim must be brought within one (1) year after it arises, or it is permanently barred, unless applicable law forbids shortening the period.
16. Suspension and termination
You may stop using the Service at any time, cancel your subscription from billing settings, and ask us to delete your account under Section 8.
We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably suspect fraud or abuse, if your payment fails, if required by law, or if we discontinue the Service. Where the circumstances allow, we will give notice first.
If we terminate your account without cause while you have paid time remaining on Jobity+, we will refund the unused portion of that period. Unused Credits are forfeited on termination.
Survival. Sections 4, 5.4, 6, 8, 9, 10.3, 11 (as to content we still hold), 12, 13, 14, 15, and 18 survive termination.
17. Changes to these Terms and to the Service
Terms. We may update these Terms. For material changes, we will give you at least 14 days’ notice by email or in the Service before they take effect. Continuing to use the Service after that means you accept the new Terms. If you do not accept them, stop using the Service and cancel your subscription.
Service. We may add, change, suspend, or discontinue features. If we materially reduce core functionality of a paid feature, we will give at least 30 days’ notice and, if you cancel before the change takes effect, refund the unused portion of your current period.
18. General
- Governing law. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act as to Section 15. For any dispute not subject to arbitration, the state and federal courts located in Wyoming have jurisdiction, without limiting your right to bring a qualifying claim in small claims court where you live.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Jobity about the Service, and supersede any prior understanding.
- Severability. If a provision is unenforceable, it is modified to the minimum extent necessary or severed, and the rest stays in force.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets. You may not assign them without our written consent.
- No third-party beneficiaries. These Terms create no rights for anyone other than you and Jobity.
- Force majeure. Neither party is liable for a delay or failure caused by events beyond its reasonable control, including outages, cyberattacks, government action, and changes made by third-party platforms.
- Electronic communications. You consent to receive notices and agreements from us electronically, at the email address on your account.
- Relationship. These Terms create no partnership, joint venture, or employment relationship between you and Jobity, other than the limited agency described in Section 5.
